EM2 Electrical Services Terms & Conditions
Please review the terms that apply when using our website, requesting service, or working with EM2 Electrical Services.
Terms & Conditions
Effective Date: October 26, 2026
These Terms & Conditions apply to services provided by EM2 Electrical Services, LLC, also doing business as EM2 Electrical (“EM2 Electrical,” “Company,” “we,” “us,” or “our”). By scheduling an appointment, approving an estimate or proposal, authorizing work, making payment, or allowing work to begin, the customer (“Customer,” “you,” or “your”) agrees to these Terms & Conditions.
1. Scope of Services
EM2 Electrical provides residential, commercial, emergency, diagnostic, repair, installation, inspection, maintenance, and related electrical services.
The specific scope of work will be based on the service requested, site conditions, written estimate, proposal, work order, invoice, electronic approval, or other written communication issued by EM2 Electrical.
Work not specifically included in the approved scope is considered additional work and may result in additional charges.
2. Service Call Fees
A service call fee may be required to schedule and dispatch EM2 Electrical to the property. The applicable fee will be disclosed before booking and may vary depending on the type of property, service requested, location, scheduling conditions, or appointment time.
When the Customer approves qualifying electrical repair or installation work resulting from the service call, the applicable service call fee will be applied as a credit toward that approved work.
The service call fee generally covers dispatch, travel, and the initial on-site evaluation.
Unless specifically stated otherwise, the service call fee does not include extended troubleshooting, diagnostic testing, repair labor, materials, permits, specialty equipment, after-hours charges, emergency premiums, or other additional services.
If no qualifying work is approved or performed, the service call fee remains payable and is non-refundable.
A service call credit has no cash value and may not be transferred to a separate property, future unrelated appointment, or different customer unless EM2 Electrical agrees in writing.
3. Diagnostic and Troubleshooting Services
Electrical troubleshooting and diagnostic work is separate from a basic service call unless expressly included in the booking or proposal.
Diagnostic charges compensate EM2 Electrical for the professional time, testing equipment, knowledge, circuit tracing, inspection, troubleshooting, and evaluation required to identify electrical conditions or failures.
Payment for diagnostic services is due for the diagnostic work performed regardless of whether:
-
a specific defect is immediately identified;
-
the Customer elects to proceed with repairs;
-
additional testing is required;
-
the condition is intermittent;
-
another contractor previously worked on the system; or
-
the problem originates from equipment or systems outside EM2 Electrical's control.
When additional diagnostic time is required, EM2 Electrical will make reasonable efforts to advise the Customer before proceeding.
4. Estimates and Proposals
An estimate or proposal is based on the information available at the time it is prepared.
Unless expressly stated otherwise, estimates do not include concealed conditions, hidden damage, inaccessible wiring, defective equipment not reasonably observable, utility-company requirements, engineering services, hazardous materials, structural repairs, drywall or finish repairs, permit fees, inspection fees, or changes required by authorities having jurisdiction.
Estimates may be revised if site conditions, requested scope, material availability, code requirements, or other circumstances differ from those reasonably anticipated.
An estimate is not a guarantee that additional work will never be necessary.
5. Authorization to Perform Work
The Customer authorizes EM2 Electrical to perform work when the Customer:
-
signs or electronically approves an estimate or proposal;
-
approves work by email, text message, electronic communication, or recorded verbal authorization;
-
makes a required deposit or payment;
-
instructs EM2 Electrical to proceed; or
-
otherwise reasonably communicates authorization.
The person approving work represents that they have authority to authorize work at the property.
6. Additional Work and Change Orders
Conditions discovered after work begins may require work outside the original scope.
Examples include concealed wiring defects, damaged conductors, improper prior installations, code violations, inaccessible equipment, failed components, unsafe conditions, or additional work requested by the Customer.
Whenever reasonably practical, EM2 Electrical will communicate additional charges before proceeding.
Emergency or safety-related conditions may require immediate action to place the electrical system in a reasonably safe condition.
Additional authorized work will be billed separately.
7. Pricing
Unless a written proposal states otherwise, pricing may include labor, supervision, overhead, tools, travel, administrative costs, insurance, licensing expenses, equipment, and other costs associated with providing professional electrical services.
Material pricing may include procurement, handling, transportation, warranty administration, storage, and business overhead.
Customers are not entitled to contractor wholesale pricing or supplier invoices unless specifically agreed in writing.
Pricing provided by telephone or based solely on photographs, videos, descriptions, or other remote information is preliminary unless expressly identified as a firm price.
8. Deposits and Payment
Deposits may be required before scheduling, ordering materials, obtaining permits, or beginning work.
Unless otherwise stated in writing, payment is due upon completion of the applicable service or upon receipt of the invoice.
For larger projects, progress payments may be required.
EM2 Electrical may suspend work for overdue balances, failed payments, expired payment methods, disputed authorization, or other payment issues.
The Customer remains responsible for payment for all authorized work performed and materials supplied.
9. Credit and Debit Card Authorization
By providing a credit or debit card or other electronic payment method, the Customer authorizes EM2 Electrical and its payment processors to charge amounts that the Customer has approved, including deposits, service charges, completed work, authorized additions, and other agreed charges.
EM2 Electrical will not intentionally charge unauthorized work.
Returned payments, chargebacks, or improperly disputed transactions do not eliminate the Customer's obligation to pay for authorized services received.
10. Cancellations and Rescheduling
Appointments should be canceled or rescheduled at least 24 hours before the scheduled appointment time whenever possible.
Late cancellations, missed appointments, denied access, or appointments where EM2 Electrical cannot reasonably perform the scheduled work may result in forfeiture of booking fees, service call fees, deposits, or other reasonable charges.
Emergency dispatch fees and after-hours fees may be non-refundable once personnel have been dispatched.
11. Emergency and After-Hours Services
Emergency, nighttime, weekend, holiday, expedited, or after-hours services may be subject to additional charges.
Emergency service pricing may differ from standard scheduled-service pricing due to availability, staffing, travel, timing, and urgency.
Payment of an emergency or after-hours premium does not guarantee that every repair can be completed immediately. Availability of replacement components, utility involvement, permitting requirements, unsafe conditions, or other circumstances may require temporary repairs or return visits.
12. Customer Access and Site Conditions
The Customer is responsible for providing safe, timely, and reasonable access to electrical panels, equipment, rooms, ceilings, crawlspaces, attics, devices, and other areas necessary to perform the work.
The Customer is responsible for moving furniture, stored materials, vehicles, equipment, or personal property unless EM2 Electrical agrees otherwise.
Delays caused by inaccessible areas, locked spaces, unsafe conditions, other contractors, occupants, pets, security procedures, or site restrictions may result in additional charges.
13. Openings and Finish Repairs
Electrical work may require reasonable openings in drywall, plaster, ceilings, walls, cabinetry, flooring, landscaping, or other finished surfaces.
Unless specifically included in the written scope, EM2 Electrical is not responsible for painting, drywall repair, plaster repair, carpentry, masonry, flooring repair, landscaping restoration, or other finish work.
EM2 Electrical will make reasonable efforts to minimize unnecessary damage.
14. Existing and Concealed Conditions
EM2 Electrical is not responsible for defects, damage, violations, failures, or unsafe conditions that existed before our work began.
This includes, without limitation:
-
damaged or deteriorated wiring;
-
improperly installed electrical systems;
-
overloaded circuits;
-
loose or damaged connections;
-
obsolete equipment;
-
recalled equipment;
-
water damage;
-
pest damage;
-
hidden junctions;
-
modifications performed by others;
-
ungrounded systems;
-
utility-company problems; and
-
concealed code violations.
Discovery of existing conditions may require additional work and additional charges.
15. Code Compliance
Work performed by EM2 Electrical will be completed in accordance with applicable electrical codes and requirements in effect for the contracted work, subject to applicable grandfathering provisions and authority having jurisdiction requirements.
When existing electrical conditions are discovered that do not meet applicable requirements, correction may be necessary before or as part of completing the requested work.
Code-required corrections that were not reasonably identifiable before work began may result in additional charges.
16. Permits and Inspections
Permits and inspections will be obtained when required and when included in the agreed scope.
Permit fees, inspection fees, engineering fees, utility fees, or similar governmental charges may be billed separately unless expressly included in the proposal.
Inspection scheduling and approval are controlled by the applicable authority having jurisdiction, not EM2 Electrical.
EM2 Electrical is not responsible for delays caused by permit offices, inspectors, utilities, governmental agencies, weather, supply shortages, or other circumstances outside our reasonable control.
17. Utility Company Work
Certain electrical work requires coordination with the electric utility or other third parties.
EM2 Electrical does not control utility scheduling, meter work, utility disconnects, utility reconnects, transformer work, service upgrades on the utility side, or utility approval processes.
Delays caused by utilities or third parties do not constitute a breach by EM2 Electrical.
18. Customer-Supplied Materials and Equipment
If EM2 Electrical agrees to install materials or equipment supplied by the Customer, the Customer assumes responsibility for the suitability, compatibility, condition, completeness, manufacturer defects, shipping damage, missing parts, and warranty coverage of those items.
Additional labor required because of defective, incompatible, incomplete, or incorrectly supplied equipment may be charged separately.
EM2 Electrical does not provide a warranty on customer-supplied materials or equipment.
19. Materials Supplied by EM2 Electrical
Materials supplied by EM2 Electrical may be substituted with reasonably equivalent products when necessary because of availability, manufacturer changes, code requirements, or supply-chain conditions.
Manufacturer warranties are subject to the manufacturer's own terms and conditions.
20. Workmanship Warranty
Unless a proposal states a different warranty period, qualifying installation and repair work performed by EM2 Electrical may include a one-year workmanship warranty beginning on the date the applicable work is substantially completed.
The workmanship warranty applies only to defects directly caused by EM2 Electrical's workmanship.
The warranty does not cover:
-
customer-supplied materials;
-
manufacturer defects;
-
pre-existing conditions;
-
normal wear;
-
abuse or misuse;
-
water intrusion;
-
pest damage;
-
utility surges or utility failures;
-
lightning;
-
acts of nature;
-
modifications or repairs by others;
-
failure of unrelated electrical components;
-
overloaded circuits caused by Customer equipment; or
-
conditions outside EM2 Electrical's reasonable control.
Warranty service does not include unrelated troubleshooting or additional work outside the original scope.
21. Safety and Right to Refuse Work
EM2 Electrical may stop, postpone, or refuse work when conditions are unsafe, unlawful, inaccessible, environmentally hazardous, or outside the agreed scope.
We may also decline work when requested work would violate applicable electrical codes, licensing requirements, manufacturer requirements, or professional safety standards.
The Customer agrees not to instruct EM2 Electrical employees or representatives to perform unsafe or noncompliant work.
22. Hazardous Materials
Unless specifically agreed in writing, EM2 Electrical does not perform environmental testing, asbestos abatement, mold remediation, lead remediation, hazardous-material removal, or similar specialty environmental services.
If suspected hazardous materials are encountered, work may be suspended until the condition is evaluated or remediated by an appropriately qualified party.
Related delays or additional costs are the Customer's responsibility unless otherwise required by law.
23. Property Protection
EM2 Electrical will use reasonable care while performing work.
The Customer is responsible for protecting or removing fragile, valuable, sensitive, or irreplaceable property from work areas.
EM2 Electrical is not responsible for damage arising from concealed defects, deteriorated materials, improper prior installations, unavoidable access requirements, or conditions that could not reasonably have been identified before beginning work.
24. Scheduling and Delays
Scheduled arrival times are estimates unless expressly guaranteed in writing.
Electrical service work can involve unexpected safety issues, emergency calls, traffic, inspections, material availability, weather, and jobsite conditions.
EM2 Electrical will make reasonable efforts to communicate significant scheduling changes but is not responsible for reasonable delays caused by circumstances outside its control.
25. Photos, Video, and Documentation
EM2 Electrical may photograph or record electrical equipment, installations, damage, thermal images, work areas, and completed work for documentation, estimating, safety, warranty, training, insurance, or business-record purposes.
We will make reasonable efforts to avoid unnecessarily capturing personally identifying information.
Images will not be used publicly for advertising or marketing when they clearly identify the Customer or private information without appropriate permission.
26. Third-Party Scheduling and Payment Services
EM2 Electrical may use third-party service providers to facilitate online scheduling, payments, website functions, customer communications, and related business operations.
When a Customer uses a third-party booking or payment service, that provider may process information under its own terms and privacy practices.
Use of a third-party service does not change the Customer's payment obligations or the scope of work authorized with EM2 Electrical.
27. Limitation of Liability
To the fullest extent permitted by applicable law, EM2 Electrical will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from electrical failures, loss of power, loss of business, loss of data, spoiled goods, equipment downtime, lost revenue, or similar losses.
EM2 Electrical's responsibility is limited to damages directly caused by our proven negligence or breach of contractual obligations, subject to applicable law.
Nothing in these Terms limits rights or remedies that cannot lawfully be waived.
28. Unforeseen Electrical Failures
Electrical systems may contain hidden defects that are not discoverable through ordinary visual inspection or limited testing.
Troubleshooting, testing, repair, de-energizing, energizing, or replacing one component may reveal failure in another pre-existing component.
EM2 Electrical is not responsible for unrelated or pre-existing system failures that become apparent during or after authorized electrical work.
29. Customer Responsibilities
The Customer agrees to:
-
provide accurate information regarding known electrical conditions;
-
disclose known hazards;
-
provide lawful access to the property;
-
obtain authorization from the property owner when applicable;
-
keep occupants and pets reasonably clear of work areas;
-
follow safety instructions provided by EM2 Electrical; and
-
promptly notify EM2 Electrical of concerns regarding completed work.
30. Collections and Unpaid Balances
Amounts not paid when due may be subject to reasonable collection costs and other remedies permitted by law.
The Customer may be responsible for reasonable costs associated with collecting unpaid balances, including collection-agency costs, court costs, and reasonable attorney's fees where permitted by contract and applicable law.
31. Disputes
Customers should promptly contact EM2 Electrical regarding any billing concern, workmanship issue, or service dispute so that we have a reasonable opportunity to investigate and address the matter.
The Customer agrees to provide reasonable access to inspect alleged workmanship defects before hiring another contractor to alter or repair the disputed work, except when immediate action is reasonably necessary to address an emergency or safety hazard.
32. Governing Law
These Terms & Conditions are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Any dispute shall be handled in a court or other legally appropriate forum having jurisdiction over the matter, unless the parties agree to another lawful dispute-resolution process.
33. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
34. Changes to These Terms
EM2 Electrical may update these Terms & Conditions from time to time.
The version applicable to a particular service is generally the version in effect when the service is scheduled, authorized, or performed, unless otherwise agreed in writing.
35. Entire Agreement
These Terms, together with the applicable estimate, proposal, work order, invoice, booking confirmation, change order, and written communications regarding the project, constitute the agreement between EM2 Electrical and the Customer regarding the applicable services.
If a written proposal or signed agreement contains terms that directly conflict with these general Terms & Conditions, the more specific written terms for that project will control to the extent of the conflict.
