Terms and Conditions for Electrical Services

Agreement Overview

By hiring EM2 Electrical Services, LLC ("we," "us," "our") for electrical services, the client ("you," "your") agrees to the following terms and conditions. This agreement is legally binding and governs the provision of all electrical services.

Our liability for any claim related to the services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the client for the specific service in question

Scope of Services

We will provide electrical services as outlined in the job estimate or written agreement, including but not limited to:

  • Electrical installation, maintenance, and repairs.

  • Inspection of electrical systems.

  • Troubleshooting electrical issues.

  • Wiring, circuit, and panel upgrades.

Additional services may be provided upon request, subject to a new estimate and written agreement.

No verbal statements shall alter or expand the scope of services without a written amendment signed by both parties.

Consultation

Upon any service, clients are required to book a consultation first.  A consultation is required for the electrician to review the project scope and needs. The price is for the electrician to be dispatched to your location, briefly review the project scope, estimate the cost, and answer any questions you may have regarding the project solely. It does not include diagnosis or repair. The consultation cost is based on the project type—residential or commercial—and the day and time it takes place. Once booked, it is non-refundable – but can be rescheduled with 24 hours of written notice. Consultation fees are non-refundable unless EM2 Electrical Services cancels or reschedules without 24-hour notice.

 

Photo & Document Policy
Estimates, invoices, and internal business documents are provided for customer use only and may not be photographed, published, or posted online without written consent from EM2 Electrical Services. Unauthorized publication or reproduction of company materials constitutes a violation of our intellectual property rights and may result in legal action.

Estimates

  • An estimate will be provided before commencing work. Estimates are based on current material and labor rates. Estimates do not guarantee fixed pricing unless expressly labeled “fixed price.”

  • The final cost may vary if additional work or unforeseen issues arise during the project.

  • The client will be notified if additional costs are expected, and work will only continue once the client has approved the revised estimate.

Payment Terms

  • Deposits and Scheduling
    A 50% project deposit is required to secure scheduling. In addition, 100% of applicable permit costs are due at the time of booking. Deposits are non-refundable, except in cases where EM2 Electrical Services, LLC (“Company”) cancels the scheduled work without rescheduling.

  • Final Payment
    The remaining balance is due immediately upon completion of the service, as determined by the completion of the agreed-upon scope of work or substantial performance of the project.
    Work may not be considered complete until all applicable inspections, documentation, or required signatures are finalized.

  • Card on File Authorization
    By providing a debit or credit card to EM2 Electrical Services, you authorize the Company to securely store your card information and charge it for the following:

  • The final balance is due upon project completion.

  • Any approved change orders or additional work;

  • Unpaid invoices or balances in accordance with these terms.

  • The card will only be charged for authorized and invoiced amounts, and a receipt will be issued after each transaction.
    Stored payment information is maintained in accordance with PCI DSS (Payment Card Industry Data Security Standards).
    You may revoke this authorization by providing written notice at least 48 hours before the scheduled charge, provided that no outstanding balance remains.

  • Accepted Payment Methods
    Accepted forms of payment include cash, check, debit card, credit card, Venmo, Zelle, and PayPal.
    A 6% service fee applies to all credit card transactions.

  • Late Payments and Collections
    Payment is due in full upon completion of work.
    Any unpaid balance more than one (1) day past due will accrue interest at 1.5% per month (18% per annum), or the maximum rate allowed by law, whichever is lower.
    In the event of nonpayment, you agree to pay all reasonable collection costs, including attorney’s fees and court costs, incurred in collecting the outstanding balance.

  • Refunds
    Deposits and consultation fees are non-refundable except where cancellation is initiated by EM2 Electrical Services. Any approved refunds will be issued at the Company’s sole discretion and may be subject to administrative processing fees.

The Company does not store card information directly; all payment data is processed and securely tokenized by our third-party payment processor in compliance with PCI-DSS standards​

Client Responsibilities

  • The client is responsible for providing access to the premises and ensuring the work area is safe and free from hazards and that the electrician may work in a hospitable environment.

  • The client should inform the electrician of any known issues or existing conditions that could affect the work, such as existing wiring issues, plumbing obstructions, or structural concerns. We are not responsible for damage or failure arising from pre-existing electrical, structural, or mechanical issues.

  • It is the client’s responsibility to obtain any necessary permits or approvals required for electrical work unless otherwise specified in writing.

  • The client is responsible for sourcing and completing any necessary drywall repairs. The company or its representatives will not complete drywall repairs.

  • The client acknowledges that electrical work may require access through walls, ceilings, or structures and agrees that EM2 Electrical Services is not responsible for cosmetic damage or restoration beyond the electrical scope.

 

Our Guarantee

The company warrants that all work will be performed satisfactorily. All materials used in the project will be new and of good quality. Work will be completed as defined in the scope of work outlined in the proposal acceptance. Any warranties for parts or materials are subject to specific manufacturer terms on such products. This warranty excludes defects caused by misuse, alteration, or repairs made by others.

Safety and Compliance

  • All work will be performed in compliance with local, state, and national electrical codes and safety standards.

  • We reserve the right to refuse to perform work that may compromise safety or violate building codes or regulations.

  • For quality assurance purposes, we reserve the right to utilize audio/visual recording. 

  • We reserve the right to refuse to perform work in a hostile or emotionally, discriminatory abusive environment.

  • We have an explicit right to remove personnel from unsafe or discriminatory environments without refund obligations.

 

Cancellation and Rescheduling

If the client wishes to cancel or reschedule an appointment, we require 24 hours of notice. We reserve the right to reschedule or cancel an appointment due to unforeseen circumstances, including but not limited to weather, illness, or emergencies. Repeated cancellations or reschedules may incur additional fees

Confidentiality and Privacy

Any personal or sensitive information provided by the client will be treated as confidential and will not be shared with third parties, except as necessary to complete the job or as required by law.

Dispute Resolution

“If a resolution cannot be reached through good-faith communication, both parties agree to submit the dispute to binding arbitration conducted in accordance with the laws of Virginia before pursuing any court action.

Force Majeure

Neither party will be held liable for failure to perform their obligations under this agreement due to circumstances beyond their reasonable control, such as natural disasters, strikes, or other unforeseeable events.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of Virginia, and any legal actions arising from this agreement must be brought in the appropriate courts located in Fairfax County, Virginia.

Acknowledgment

By hiring us for electrical services, you acknowledge that you have read, understood, and agree to these terms and conditions: 

  • Limitation of Liability Clause (see above)

  • Indemnification Clause:

    You agree to indemnify, defend, and hold harmless EM2 Electrical Services, LLC, its owners, employees, and agents from and against any claims, damages, or losses (including attorney’s fees) arising out of your negligence, misuse, or failure to follow our recommendations.

  • Entire Agreement Clause:

    This document constitutes the entire agreement and supersedes all prior communications.
